If the defendant complies with the obligations set by the court and does not commit any new intentional crimes during the probationary period, the sentence is dismissed. <\/p>\n<p data-start=\"382\" data-end=\"643\">The dismissal of the judgment in this sense means that the case is dismissed. This legal institution, as provided for in the Code of Criminal Procedure (CCP), aims to rehabilitate the individual and prevent the creation of a criminal record in cases involving relatively minor offenses or those warranting a lighter sentence. <\/p>\n<hr data-start=\"645\" data-end=\"648\">\n<h2 data-section-id=\"k0x05n\" data-start=\"650\" data-end=\"677\">Legal Basis and Scope<\/h2>\n<p data-start=\"679\" data-end=\"835\">The suspension of the pronouncement of the judgment is primarily governed by Article 231 of the Code of Criminal Procedure. It may be applied if the conditions set forth in the article are met. <\/p>\n<h3 data-section-id=\"1kelfil\" data-start=\"837\" data-end=\"863\">Conditions Under Article 231 of the Criminal Procedure Code<\/h3>\n<ol data-start=\"865\" data-end=\"1193\">\n<li data-section-id=\"1lqy7pg\" data-start=\"865\" data-end=\"960\">If, at the conclusion of the trial, the defendant is sentenced to imprisonment for two years or less or a fine,<\/li>\n<li data-section-id=\"19p4vh5\" data-start=\"962\" data-end=\"1027\">The fact that the defendant has no prior conviction for a felony,<\/li>\n<li data-section-id=\"oujhmj\" data-start=\"1029\" data-end=\"1095\">The court forming the opinion that the defendant will not commit a crime,<\/li>\n<li data-section-id=\"w3h0cr\" data-start=\"1097\" data-end=\"1193\">The redress of the harm caused by the commission of the crime through restitution or compensation,<\/li>\n<\/ol>\n<p data-start=\"1195\" data-end=\"1463\">The fulfillment of each of the four conditions listed above is a prerequisite for issuing this decision. To reiterate this point, if any of the conditions listed above is not met, a decision to suspend the pronouncement of the sentence cannot be issued against the individual. <\/p>\n<p data-start=\"1465\" data-end=\"1700\">The defendant must agree to the suspension of the pronouncement of the judgment. During the trial, the court determines whether the defendant has agreed to the suspension of the pronouncement of the judgment. <\/p>\n<hr data-start=\"1702\" data-end=\"1705\">\n<h2 data-section-id=\"rsm8ni\" data-start=\"1707\" data-end=\"1742\">For Which Crimes Can HAGB Not Be Applied?<\/h2>\n<p data-start=\"1744\" data-end=\"1847\">A decision to suspend the pronouncement of a sentence cannot be made in cases involving crimes punishable by more than two years in prison.<\/p>\n<p data-start=\"1849\" data-end=\"1972\">In addition, specific laws stipulate that a decision to defer the pronouncement of a sentence cannot be issued for certain crimes.<\/p>\n<hr data-start=\"1974\" data-end=\"1977\">\n<h2 data-section-id=\"8kh76p\" data-start=\"1979\" data-end=\"2040\">Consequences of a Decision to Postpone the Announcement of the Judgment<\/h2>\n<ul data-start=\"2042\" data-end=\"2791\">\n<li data-section-id=\"6vhn2s\" data-start=\"2042\" data-end=\"2158\">If a decision is made to suspend the pronouncement of the sentence, the defendant is subject to a probationary period of five years.<\/li>\n<li data-section-id=\"1atp2ph\" data-start=\"2160\" data-end=\"2330\">During the probation period\u2014that is, within five years of the date of the decision\u2014a decision to suspend the pronouncement of a sentence may not be issued against the individual for an intentional crime.<\/li>\n<li data-section-id=\"93khpz\" data-start=\"2332\" data-end=\"2441\">In addition, provisional measures may be ordered for a period not exceeding one year during the audit period.<\/li>\n<li data-section-id=\"g9uavd\" data-start=\"2443\" data-end=\"2791\">If, during the probation period, the defendant does not intentionally commit a new crime and complies with the terms of probation, the suspended sentence is declared \u201cdismissed.\u201d Otherwise, that is, if the defendant intentionally commits a new crime or violates the terms of probation during the probation period, the court will pronounce the sentence. <\/li>\n<\/ul>\n<p data-start=\"2793\" data-end=\"3163\">However, the court will make a determination in this matter. In doing so, by assessing the defendant\u2019s conduct\u2014which has violated the terms of probation\u2014the court may decide not to enforce up to half of the sentence. If the conditions are met, the court may decide to suspend the prison sentence imposed in the judgment or convert it to alternative sanctions.  <\/p>\n<h3 data-section-id=\"8zlh06\" data-start=\"3165\" data-end=\"3187\">Impact on the Criminal Record<\/h3>\n<p data-start=\"3189\" data-end=\"3405\">In practice, a decision to suspend the pronouncement of a sentence does not appear on the criminal record. Decisions to suspend the pronouncement of a sentence are recorded in a system accessible to judges and prosecutors. <\/p>\n<hr data-start=\"3407\" data-end=\"3410\">\n<h2 data-section-id=\"xniu6d\" data-start=\"3412\" data-end=\"3420\">Result<\/h2>\n<p data-start=\"3422\" data-end=\"3808\">Suspension of Sentence is an important institution within the criminal justice system aimed at individualization and social rehabilitation.
